Terms and Conditions

1. Introduction

These Terms and Conditions (“Agreement”) govern the provision of at-home pet euthanasia services (“Services”) by Sundown Vets (“we,” “us,” or “our”). By booking or using our Services, you (“Client,” “you”) agree to be bound by this Agreement.

This Agreement is governed by the laws of England and Wales.

2. Regulatory Compliance

Our Services are carried out in accordance with:

  • The Veterinary Surgeons Act 1966
  • The Animal Welfare Act 2006
  • The Royal College of Veterinary Surgeons (RCVS) Code of Professional Conduct

All euthanasia procedures are performed by a registered veterinary surgeon or under their direction, as required by law.

3. Services Provided

We provide compassionate, in-home euthanasia services for pets, including consultation, sedation, euthanasia, and optional aftercare arrangements.

Services are provided in a professional and humane manner consistent with UK veterinary standards.

4. Eligibility and Consent

By using our Services, you confirm that:

  • You are the legal owner of the pet or have the owner’s explicit permission.
  • You are aged 18 or over.
  • You have the legal authority to consent to euthanasia.

You provide informed consent for euthanasia and understand that:

  • The procedure is irreversible.
  • You have had the opportunity to ask questions.

We reserve the right to refuse to carry out euthanasia if it is not clinically or ethically appropriate under RCVS guidance.

5. Clinical Decision-Making

The attending veterinary surgeon retains full clinical discretion regarding:

  • Whether euthanasia is appropriate
  • The method used
  • Any sedation required

This decision will be made in accordance with professional obligations and animal welfare law.

6. Fees and Payment

  • Fees will be clearly communicated at the time of booking.
  • Payment is due before the appointment unless otherwise agreed.
  • Additional charges may apply for travel, out-of-hours services, or additional aftercare.
  • Accepted payment options: Cash or bank transfer

7. Cancellation and Rescheduling

  • We request a minimum of 2 hours notice for cancellations. If you need to reschedule, please let us know at least two hours before the appointment. We are going to do our best to accommodate a different date and time suitable for you and your family.
  • If you decide at the time of the appointment that you don’t want to go ahead with the euthanasia, the full fee will be still payable.
  • We reserve the right to cancel or reschedule appointments in exceptional circumstances.

 

8. Client Responsibilities

You agree to:

  • Provide accurate and complete information about your pet’s health and behaviour.
  • Ensure a safe environment for our staff.
  • Inform us of any risks (e.g. aggression, infectious disease).

We reserve the right to withdraw Services if staff safety is at risk.

9. Procedure Acknowledgment

You understand that:

  • Euthanasia typically involves sedation followed by administration of a euthanasia agent.
  • Physical responses (e.g. muscle movement, vocalisation, breathing changes) may occur.

While we aim to provide a peaceful passing, variations may occur depending on the pet’s condition.

10. Aftercare Services

Where offered, aftercare (e.g. cremation) is provided via third-party providers.

We will:

  • Explain available options and costs
  • Take reasonable care in handling your pet

We are not responsible for acts of omission of third-party providers. In the event of damage or loss of the ashes, we can only refund the fee for cremation.

11. Data Protection and Privacy

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Your information will be used solely for:

  • Providing veterinary services
  • Record keeping
  • Legal and regulatory compliance

You have the right to access your data and request corrections where applicable.

12. Limitation of Liability

We understand that saying goodbye to a beloved pet is an emotional and deeply personal experience. We are committed to providing a caring, professional, and respectful service at all times.

Nothing in these terms limits or excludes our responsibility for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded under applicable law, including your rights under the Consumer Rights Act 2015

Subject to the above:

  • We are not responsible for any indirect or consequential losses. This may include, for example, emotional distress beyond what is reasonably foreseeable, loss of income, or other secondary impacts that are not directly caused by our service.
  • To the fullest extent permitted by law, our total liability to you for any claim arising out of or in connection with our services shall be limited to the amount you have paid for those services.

13. Emergency Services

We do not provide emergency veterinary services.

If your pet requires urgent care, please contact a local emergency veterinary practice.

14. Complaints

If you are dissatisfied with our service, please contact us in writing at sundownvets@outlook.com

We aim to resolve complaints promptly in line with RCVS guidance.

You may also raise concerns with the Royal College of Veterinary Surgeons (RCVS).

15. Force Majeure

We are not liable for failure to perform our obligations where such failure results from events beyond our reasonable control, including but not limited to severe weather, illness, or transport disruption.

16. Amendments

We may update these Terms from time to time. The latest version will be available upon request or on our website.

17. Governing Law and Jurisdiction

This Agreement is governed by the laws of England and Wales, and disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
